Guide to the prevention of social dumping in public contracts
On June 30, the Chancellery of the Prime Minister published its Guide to the prevention of social dumping in public contracts.
Resulting from a consultation with different stakeholders, notably the construction sector, it aims to encourage contracting authorities to use all the possibilities offered by the new regulations on public procurement in order to ensure fair competition between economic operators.
While it emphasises the different stages of a procurement procedure (in particular, the verification of grounds for exclusion) and the procedure for awarding a public contract (a notable element is the soundness of the reasoning regarding use of the "social" criteria as awarding criteria), it also deals with their execution (formative clause).
Highly practical, it lists several internet links allowing readers to supplement their information on other legislations such as legislation on public procurement (minimum wage, social security and accreditation of contractors, for example).
