Public procurement: 2016 thresholds

Modification of the thresholds for applying the Directives aimed at the “Classical Sector”, “Utilities Sector”, “Defence and Security”, and “Concessions”

The European Commission has just communicated to the Member States the draft regulation setting out new thresholds for the application of European Directives 2004/17 (public procurement in the utilities sector), 2004/18 (public procurement in the “classical sector”), 2009/81 (public procurement in the fields of defence and security), 2014/24 public procurement in the “classical sector”), 2014/25 (public procurement in the utilities sector), and 2014/23 (concessions contracts).

As of 1 January 2016, these thresholds will be increased from:

  • € 134,000 to € 135,000 excluding VAT for public supply and service contracts for central government authorities;
  • € 207,000 to € 209,000 excluding VAT for public supply and service contracts for local or regional authorities;
  • € 414,000 to € 418,000 excluding VAT for public supply contracts and service contracts by contracting entities and for public supply contracts and service contracts in the fields of defence and security;
  • € 5,186,000 to € 5,225,000 excluding VAT for public works contracts and concessions contracts.
